Turning to criminal matters, we have acted for clients regarding felonies and misdemeanors in the U.S.  and indictable and summary conviction offenses in Canada concerning: (1) theft; (2) assault; (3) great bodily harm less than murder; (4) driving under the influence; (5) destruction of property; (6) public intoxication; (7) extradition; (8) bail; (9) conspiracy; (10) trafficking narcotics within the U.S. and across an international border; (11) probation violations; (12) illegal search and seizure; (13) double-jeopardy; (14) Miranda and right to counsel violations; (15) domestic violence; (16) probation violations; (17) resisting arrest; (18) ineffective assistance of counsel; and (19) criminal sexual conduct.

Recent and Past Successes

2025:

  • Obtained Summary Judgment, Case No. 2024-210554-CB, Oakland County Circuit Business Court, 8 January 2025. Plaintiff did not appeal.
  • Resisted government’s attempt to revoke probation at evdientiary hearing, Case No. 2024-287512-FH, Oakland County Circuit Court, 4 February 2025.
  • Moved for, and obtained order, declaring term of probation that husband convicted of aggravated domestic violence have no contact with wife during three year probation, is unconstitutional, Case No. 2024-287512-FH, Oakland Country Circuit Court, 12 March 2025. Government did not appeal.
  • Obtained dismissal, without prejudice, of mutiple counts of welfare fraud, Case No. 2024-004581-FY,  52-4 District Court, Troy, Michigan, 21 March 2025.
  • Obtained dismissal, with prejudice, of retail fraud first degree at preliminary exam, Case No. 2025-000621-FY, 52-4 District Court, Troy, Michigan, 1 April 2025. The government did not appeal.
  • Obtained diversion, with probation, under domestic violence abuse act, for woman who had used pepper spray on boyfriend, Case No. 2025-000518-FY, 52-1 District Court, Novi, Michigan, 9 April 2025.
  • Obtained diversion, with probation, under HYTA, for young man during a Terry stop that erupted into fight between him and the police, Case No. 250044-FY, 50 District Court, Pontiac, Michigan, 15 April 2025.
  • Resisted government at sentence review hearing to set-aside sentence agreement and revoke sentence, Case No. 2023-283603-FH, Oakland County Circuit Court, 23 April 2025.

2024:

  • Obtained Ex Parte Temporary Restraining Order, Preliminary Injunction, and settlement with Corwell Health and Lincoln Financial that all of the funds, U.S. $71, 976.52, in an ERISA 403(b) retirement savings account of a deceased physiotherapist, who was a Canadian citizen and a Canadian resident, goes to her estate in Canada and not to her former husband. Also obtained a default judgment against former husaband of U.S. $104, 345.94, plus pre and post-judgment interest. Furthermore, court awarded McTavish Law attorney’s fees at the second highest hourly rate in Michigan, U.S. $600. Case No. 23-cv-11700, E.D. Mich., 11 June 2024. 
  • Obtained confidential settlement on behalf of Rick Patel and against General Motors, LLC, Michael Skehan, and Kevin McCabe regarding claims of discrimination based on Patel’s race, color, and national origin. Case No. 22-cv-10742, E.D. Mich. 30 October 2024.

2023:

  • Obtained Order from the Michigan Court of Appeals that reversed the Order and set-aside the Judgment of the Wayne County Circuit Business Court that denied motion to change venue from that court to the Oakland County Circuit Court. COA Case No. 365035, 14 December 2023.
  • Successfully petitioned the Michigan Court of Appeals to consider application for leave to appeal immediately and obtained leave to appeal and stay of Order of Wayne County Circuit Business Court that denied motion to change venue. COA Case No. 365035, 4 April 2023.
